The present work aims to develop a study on the Criminal Non-Prosecution Agreement, a legislative novelty in the Brazilian legal system that allows crimes with less offensive potential to be resolved more quickly without the need for the entire judiciary to resolve these issues. criminal offenses and consequently further burden the Brazilian judiciary. The ANPP is a measure that came to mitigate the procedural slowness caused by the overcrowding of processes, to this end it relies on a series of rules brought by Law n° 13.964/2019, known as the Anti-crime Package, this legislative novelty also has numerous foundations and requirements for its application, which in the course of this study will be clarified from its creation, legal basis, applicable principles, favorable and unfavorable points, as well as the legal impacts. For this, the research was based on an extensive bibliographical review that included important scientific articles, government reports, books and academic documents dating from 2004 to 2024. Studies were considered that cover everything from the creation of a negotiating criminal system through the impact of the Agreement of Non-Criminal Prosecution, until the resolution of conflicts of its application.
