THE SOCIAL FUNCTION OF RURAL PROPERTY: CARBON CREDIT AS THE SOLUTION TO FULFILL THE FUNCTION OF RURAL PROPERTY

The study deals with the use of rural property in a sustainable way so that it obtains its social function. The main problem that we intend to answer in the course of the work is whether the rural property that uses carbon credit complies with the stipulations of article 186 of the 1988 Federal Constitution, regarding the social function of the rural property. The general objective of the present work is to analyze whether rural property, when using carbon credit, fulfills the function of rural property provided for in article 186 of the 1988 Federal Constitution. The method used is deductive, which starts from the approach of theories and laws. In addition, bibliographic research is used. Regarding procedures, the research is classified as qualitative. Regarding the results, it is pointed out that the current agricultural scenario does not comply with the requirements listed in article 186 for fulfilling the social function of property. The conclusion was reached that the regulation of carbon credits in the Brazilian system is an urgent measure, so that the greenhouse effect can be reduced and the lives of future generations can be preserved.
