PARENTAL BURNOUT AND VIOLATION OF THE PRINCIPLE OF EQUALITY BETWEEN SPOUSES: DISCUSSIONS ABOUT PARENTAL DUTIES IN SHARED CUSTODY

The aim of this article is to present a study on the influence of parental burnout on families that adopted shared custody, a syndrome in which there were large numbers of cases during the COVID-19 pandemic. Contrary to what one might imagine, burnout is not just linked to work, hence the importance of conceptualizing and differentiating occupational burnout from parental burnout. In this research, some real cases of both people who were diagnosed with parental burnout syndrome and people who experience shared custody are analyzed in order to conclude that the principle of equality between spouses has been violated. In the end, it was realized that violation of the principle of equality between spouses can cause parental burnout, as well as the need for legal provisions in order to guarantee the implementation of principles and a reduction in the rates of this syndrome.
