ONLINE DISPUTE RESOLUTION AS MECHANISM FOR ENHANCEMENT OF ACCESS TO JUSTICE

This is a study on the importance of Online Dispute Resolutions (ODRs) as an instrument for ensuring access to justice. To this end, it discusses the concept, its advantages and how does it happen the applied in Brazil. Carrying out this research was out using the dissertation method through bibliographical research of articles and analysis of the work by Cappelletti and Garth entitled The Access to Justice. Regarding the use of the ODR system as a mechanism for access to justice, there is an approach to these tools and the obstacles still encountered. Obstacles that also reflect on the Judiciary, regarding the implementation of the guarantee of the right of access to justice, in order to promote the full exercise of citizens with regard to the guarantee of other fundamental constitutional rights. It is concluded that ODRs are seen as a mechanism for access to justice through democratic application, although there are still obstacles that hinder the full implementation of these systems in Brazil.
