FATHER IS WHO CREATES: SOCIO-AFFECTIVE AFFILIATION IN THE BRAZILIAN LEGAL ORDER

This article aims to analyze the recognition of socio-affective affiliation through Provisions 63, 93 and 149 of the CNJ. To this end, qualitative bibliographic research was used, highlighting the aforementioned Provisions. Provision 63 allowed the recognition of affiliation directly in the Civil Registry Offices of Natural Persons, demonstrating its importance, while Provision 93 sought to fill the gaps left so that the path towards equity between socio-affective affiliation and natural affiliation became more significant and, with the arrival of Provision No. 149, there was continued evolution in socio-affective affiliation, however a setback in preventing affiliation from being recognized in notary offices. Finally, it was possible to notice an increasing move towards the dejudicialization of the recognition of the socio-affective bond and all the resulting effects.
