CRISIS PREVENTIVE PROCEDURE

Abstract

In this paper a revisión of the institution know as “Preventive Crisis Processing” is realized, pertaining to the labor law branch in Argentina, used to face economic crisis and protection for the employer and the employee. In the first place, the origin is exposed, how the procedure arose as seen on the law 24.013, and the Argentinean Work Law (law 20.744). Nex, it describes the active legitimation and the procedural process, by the administrative authority and it’s role both in the suspensions as in the dismissals for major reasons and economic crisis. Lastly, it is explained it’s preponderance and it’s usage during the inflationary process that Argentina is currently going through.
