INTERSECTIONALITY IN AN ERA OF WORSENING SOCIAL RIGHTS: IMPLICATIONS FOR THE SOCIAL SECURITY SYSTEM

This work seeks to analyze the relationships between the social security system and human rights, based on the concept of intersectionality. The issue of effective access to social security rights and benefits will be examined based on national and international law and human rights. To this end, the research includes an analysis of the main systemic obstacles faced by the insured and how the legal system has strived to guarantee (or not) fair and affordable access to the insured and beneficiaries of social security, especially two groups with intersectional areas: black women and transsexuals and transvestites. The objective is to analyze the causes of the difficulties and how the State, through its scope, can deal with these conditions in the best way possible, in order to enforce the provisions of many normative and doctrinal mechanisms. The research methodology will seek to reconcile qualitative and quantitative methods with the purpose of interpreting facts and situations based on data and statistical foundations. A data collection will be carried out to understand the real situation of the problem, as well as its motivations and its impact on the Brazilian legal and social system. From these steps, we will seek to better understand the situation of the applicability of intersectionality in access to social security rights, discussing a primordial right that must be guaranteed to everyone who is entitled to it: the right to social insurance.
