do da tradução The purpose of this article is to identify the current situation of the Brazilian prison system and present its main problems, thus pointing out the principle of human dignity. The destructuring of the prison system highlights the neglect of prevention and prisoner rehabilitation. In this way, Brazilian society finds itself in a moment of extreme abandonment in the face of the current Brazilian prison system, as on the one hand there is a sharp increase in violence and, on the other hand, prison overpopulation and harmful prison ills. Several factors contribute to a precarious prison system. However, the abandonment and neglect of public authorities over the years have further aggravated the disorder of the Brazilian prison system. The Criminal Execution Law (LEP) itself, in its art. 88, provides that the sentence must be served in an individual cell, with a minimum area of six square meters. Furthermore, art. 85 of the LEP provides that there must be compatibility between the physical structure of the prison and its capacity. Overcrowding in the prison system is one of the biggest problems, preventing any type of resocialization and care for the prison population, which leads to constant rebellions. It should also be noted that food is precarious, and medical assistance, hygiene and other elements necessary for the lives of prisoners are insufficient. Therefore, prison, which, however, emerged as a way to avoid crime, does not achieve the effective resocialization of the prisoner.Downloads
