FLAGRANT FORGED IN PRISONS FOR DRUG TRAFFICKING: THE REALITY OF THE BRAZILIAN CRIMINAL SYSTEM

The present article, in its legal scope, sought to analyze jurisprudentially the issue of forged arrests for drug trafficking. This explanation seeks to further uncover the reality of the Brazilian penal system and prisons with this classification, as doctrinally it does not have much notoriety. The flagrant forgery is proof of a structural selectivity in prison systems which, in short, is not much addressed as it points to illegality, where forged prisons are considered extralegal and may cause the process to be null and void. As a result of the above, the methodology of this work was based on an analysis of scientific articles and legislation on the subject. Qualitative methods used to get to the heart of the problem addressed in this study in the most realistic way. Some results found in the materials analyzed indicate that the forgery in trafficking cases is directed at a certain class of society: black, poor and low social class.
