Abstract

With rapid digitization, understanding the strengths and weaknesses of online hearings becomes essential to refine and develop more effective strategies in dispute resolution. Therefore, the study aimed to explore, through bibliographic review, the effectiveness of online mediation and conciliation hearings compared to their in-person counterparts. Digital mediation and conciliation hearings currently represent an approach to judicial policy for access to justice, yet doubts persist about their implementation. Thus, while online sessions may be as effective as in-person ones, it is crucial to consider these aspects to maintain the quality and efficiency of the process in seeking satisfactory agreements. Despite the challenges, virtual hearings have gained acceptance and popularity, especially in situations where physical presence is not crucial. With technological advancements and clear guidelines for their execution, they continue to be a valuable and convenient option for resolving conflicts. Therefore, despite the inherent challenges of virtual sessions, it is undeniable that they offer a valuable and effective alternative for seeking satisfactory agreements.
