TRAFFICKING IN PERSONS: THE CHALLENGES IN COMBATING THE CRIME OF TRAFFICKING IN PERSONS FROM A SOCIAL AND LEGAL PERSPECTIVE IN BRAZIL

Human trafficking is the third most lucrative crime in the world. Because it is a crime that has multiple faces (according to its typification in article 149-A of the penal code) it becomes difficult to identify, causing several difficulties in its penalization through the criminal justice system. The methods used to carry out this article were based on exploratory and descriptive research, using narrative review, through scientific articles made available by specialists in the area, as well as through Google Scholar. From this review, it was noted that human trafficking, in addition to seriously injuring the human rights of the victim, there are several challenges faced by criminal justice, among them, the identification of the crime. It is concluded that there is a need for the State, in harmony with its jurisdictional function, to take the lead in combating human trafficking through public policies, as well as training the technical staff of the courts to identify the crime, making it crucial the creation of specialized courts in relation to human trafficking.
