A STUDY ABOUT THE DELAY OF THE INSS IN ANALYZING APPLICATIONS AND THE USE OF THE WRIT OF MANDAMUS

The present study aimed to address the INSS delay in analyzing administrative requests and the use of the writ of mandamus. Given the narrative of the topic covered, the following question emerged: what are the main factors that contribute to the slowness of the INSS in analyzing social security applications? Thus, the general objective was to analyze the delay in administrative procedures before the INSS. The specific objectives, in their entirety, were intended to understand the progress of the administrative process and its regulatory standards, investigate the causes that lead to slowness in social security procedures, present measures to solve the problem and alternative means to the writ of mandamus. The methodology adopted was based on a qualitative empirical approach, using bibliographical research procedures, review of books, published articles, Brazilian legal system and jurisprudence. The searches were carried out on electronic research platforms such as SciELO, Google Scholar and academic repositories. Finally, through the research conducted to structure this work, it was possible to explore effective solutions, such as hiring new employees, efficient execution of internal resources and improving the ombudsman's performance. These measures aim to mitigate the elements that generate the aforementioned problem, in addition to promoting understanding of the procedural aspects of administrative processes, as well as the main factors that generate delays, and proposing alternatives to seeking a writ of mandamus in judicial spheres.
