The aim of this work is to analyze the abandonment of domestic animals that are left exposed on the streets of Brazilian cities and the responsibility of the state in this situation, as well as the duty to seek accountability for guardians who abandon animals. To this end, this work was based on theoretical research in bibliographic materials, as well as through searches for data that can contribute to a better foundation for the development of the theme. In addition, doctrinal and jurisprudential research was carried out on the subject, with the aim of demonstrating how domestic animals are treated by the Brazilian legal system, the duties of the state and the guardian in guaranteeing the well-being of the animal, aiming for a balanced environment that does not go against the rules in force in the legal system. In addition, we sought to turn our attention to the provisions of the Magna Carta, the Civil Code and Law No. 9.605/97, which deals with environmental crimes, for a better development of the subject.
