This work reports on the major problems faced by Brazil, which is very old in the prison system, which is the overcrowding of cells, the domination of the system by criminal factions, as well as unhealthy conditions, the proliferation of epidemics and the consumption of drugs in the units, these are one of the many problems that Brazil faces in resocializing a detainee who will be handed over to society without having understood the purpose of serving the sentence and will have a high probability of returning to a penitentiary, as the due role of the detainee's imprisonment was not fulfilled duly generating chaos for the state and for the detainee who is not resocialized. The research investigates the impact of overcrowding on prisoners' living conditions and reintegration, highlighting the need for a more preventive approach to Criminal Law and investments in rehabilitation programs. The difficulties in resocialization are real and complex obstacles. The lack of investment in job training and education programs within prisons, combined with social stigmatization, creates significant challenges for inmates' reintegration into society. To overcome these difficulties, it is imperative to invest in education, professional training, post-penalty assistance and public awareness.
