THE CONTINUED ASSISTANCE BENEFIT IN LIGHT OF THE PRINCIPLE OF THE DIGNITY OF THE HUMAN PERSON

LOAS supports citizens in situations of poverty, however, with its own specificities. The elderly or disabled need to have a quality of life where they have respect and consideration from the State and the community so that they obtain guaranteed fundamental rights and duties. The general objective was to analyze the principle of Human Dignity in light of the LOAS right, observing whether in fact the elderly and disabled who are in vulnerable conditions find it easy to access their rights and duties. The specific ones, demonstrate the LOAS and its corresponding concepts for the elderly and people with disabilities; verify the Assistance Benefit as a mechanism to defend the Dignity of the Human Person and; explain the conduct of the Superior Courts in relation to the financial criteria for granting the BPC. Therefore, bibliographical research was used in the methodology, using the basic nature, deductive method, containing the descriptive technique as a qualitative approach and scope. The IBGE predicts that the number will continue to grow until 2050, that is, Brazil will have around 34.3 million elderly people. This growth requires investments through public policies, and the State must be prepared to provide them with decent living conditions, after all, it is not enough to take care of these people's health and guarantee a longer life so that they can live with dignity. Therefore, we must respect the fact that people with disabilities are also living longer and longer, and must receive adequate treatment, whether from the countryside or from society.
