O TERMO CIRCUNSTANCIADO DE OCORRÊNCIA E A SUA LAVRATURA PELAS POLÍCIAS OSTENSIVAS – PM E PRF

Abstract

The study presents the Public Administration as competent to seek improvement in the provision of its services to society. Thus, the Security System has in its apparatus the possibility of presenting positive results to society regarding the solution of cases. The promulgation of Law 9099/95, the Law of Special Courts, among other situations, presents the reduction of bureaucracy to conclude crimes of less offensive potential. For that, the Circumstance Term of Occurrence - TCO - made by the police authority is the primary element, as it is the instrument sent to the Special Court. The proposal in this article aims to analyze the issue surrounding the TCO that has unfolded since the accession of Brazilian states to the drawing up by the police authorities, specifically the Military Police and the Federal Highway Police.It also presents the most recent decisions on TCO. Finally, in addition to providing an overview of the states that have already joined the system, the positive aspects that society already experiences are presented, based on the speed given to the resolution of cases. The study is based on the text of the law, decisions of the courts, the literature of legal experts in the area, research carried out and publications on the subject.
