OBSTETRIC VIOLENCE AND THE CIVIL RESPONSABILITY OF AGRRESSORS

More frequently than in the past, obstetric violence has been noted as a practice in the hospital environment, carried out by health professionals who, negligently, recklessly or even intentionally, carry out acts that are incompatible with the vulnerable state of patients. This type of violence is characterized by violations that affect the physical and moral integrity of pregnant women before, during or postpartum and, in the context of the hospital area, occurs in public and private hospitals, including reference hospitals. This is gender-based violence, especially because it takes into account peculiar and unique aspects of women. This work aims to analyze the civil regulations punishing obstetric violence, since, currently, there is no legislation that directly and effectively protects the victims of the event. Thus, articles and jurisprudence are analyzed using qualitative methodology, concluding, in a non-exhaustive way, that this type of violence is still unknown to many women and should be the object of study and discussion in the social and legal environment.
