It is known that LGBTQIA + people suffer prejudices within society and this is reflected in the legal system, making these people have their rights historically shaken simply by loving a person of the same sex or by being born with a sexual organ that does not match their own real gender identity. Regardless of sex, gender or sexual orientation, everyone should have the right to start a family and one of those ways would be through adoption. This work, then, aims to bring the need to expand the concept of family in the legal system due to the difficulties faced in the adoption process by LGBTQIA + people, analyzing the evolution of the concept of family in the legal system and aiming to show the importance of adoption with due full protection of the child and adolescent. This work will have bibliographical research as its primary source, exploring the largest possible number of content, these being present in books, laws, scientific articles, monographs, theses, dissertations and research on the internet to obtain information with greater precision and clarity about all objectives that it is intended to be achieve with this work. After all the analysis, it is concluded that for the legal system to guarantee its objective of generating harmony and social peace, it is extremely important to expand the concept of family, especially in a positive way, to guarantee the adoption by LGBTQIA+ people expressly, obeying the principle of integral protection.
