DIGITAL PERSONALITY: FREEDOM OF EXPRESSION ON THE INTERNET IN THE LIGHT OF BRAZILIAN LEGISLATION

Freedom of expression on the internet is a complex topic and is under constant debate. Although the internet allows the free expression of opinions, it is necessary to consider legal and ethical issues, such as privacy, security and human dignity. The general objective of this work is to reflect on digital personality by analyzing its functioning in conjunction with the right to freedom of expression and the limits imposed by Brazilian legislation. The study raises the following question as a problem: what is the balance to guarantee freedom of expression on the internet and at the same time protect the rights and interests of other people, groups and institutions? While seeking to answer this question with the following specific specific objectives: Provide a contextualization of the issues covered in the topic with freedom of expression as the main focus, then analyze freedom of expression focusing on its functioning in the internet era considering for such as the Civil Rights Framework (LAW No. 12,965/2014), finally, addressing digital personality in light of the fundamental rights of third parties. Regarding the topic discussed, it is worth saying that laws and regulations vary according to the country and technology companies play an important role in regulating content on the internet. It is essential that there is open and continuous dialogue involving governments, companies and civil society to find a balance between protecting rights and promoting an open and inclusive internet. Internet users must also take responsibility for their words and actions, and education about the limits of free speech is crucial. Freedom of expression on the internet must be seen as a fundamental human right and promoted with a guarantee of accessibility and digital inclusion for all, fighting against censorship and restriction of access to information. Therefore, it is fair to say that the present study is important and current, especially in an increasingly digitally connected world. The methodology used was a systematic literature review, in a qualitative nature, using applicable legislation and articles as a database.
