PROTECTION OF FAMILY PROPERTY AND SMALL AND MEDIUM PROPERTY

Brazilian society is marked by a large number of rural properties, which come in different sizes and are regulated not only by the Federal Constitution, but also by special laws, including the Land Statute and the Agrarian Reform Law. Several issues involving assets related to agrarian law arise, starting mainly with the importance of ensuring security in the performance of this economic activity, which occurs essentially with the provision of guarantees for workers and small rural producers. Since this is a matter that involves not only the right to property, but is also related to the social function for which it is intended and the need for environmental protection, this legal research aims to clarify the doubts surrounding rural properties of smaller territorial expression, which are the so-called family properties, small and medium-sized properties and the protection given to them by the legislation in force. Having made these considerations, the study is developed through bibliographic research, carried out throughout the year 2025, with transcription of legal texts, understandings of doctrinaires and case law, selected through qualitative analysis of the bibliographic material.
