National policies in the field of public health are essential to ensure the well-being and quality of life of individuals. The general objective of this analysis is to examine the State's responsibility to guarantee public order for a given group. The specific objective is to show the importance of the fight against asylum in relation to the rights of people with mental illnesses from the beginning of the asylum until the present day. In addition, it aims to analyze how the State intervenes in the most serious events in the social environment and discuss the responsibility of the State in these situations. The purpose of this analysis is to understand how countries can act more effectively and fairly in promoting public health and guaranteeing their rights. In the research, the Dialectical Method and the historical procedure method were used, in which the research will be classified in a qualitative and exploratory way, since it aims to improve the ideas that exist in relation to the problem in question. It is important to emphasize that the techniques used for data collection in the research were based on (bibliographical research, which is based on the study of doctrinal concepts, and documentary research, through legal provisions). In the method of procedure, doctrines were used in order to raise a historical repertoire on the subject and structure a resistant theoretical basis for carrying out the work. With the collection of all data on the subject, it was found in the research that the State's methods are still very deficient, since there is a lack of more humanitarian public policies.
