PREDATORY DEMANDS AS A FACTOR IN VIOLATION OF THE PRINCIPLE OF REASONABLE DURATION OF THE PROCESS

This article aims to present an analysis of predatory demands as a factor in violation of the principle of reasonable duration of the process. To this end, the objective of the study is to verify whether predatory demands negatively impact the effective implementation of access to justice. To address the context in focus, it was discussed to observe the growing increase in the judiciary of so-called predatory demands and how this phenomenon can impact the judiciary in the provision of jurisdiction, since the citizen must be guaranteed access to Justice through a reasonable duration of the process. This research was developed using the deductive theoretical approach method, and the methodology of legal research, through the bibliographic and documentary exploratory technique. Based on the information obtained, it was found that predatory demands harm the proper functioning of the legal system, which can lead to an accumulation of processes, increasing delays and resulting in a violation of the rights of the parties involved. It is concluded, therefore, that even with the courts' moves to alleviate the large volume of these demands, they often go unnoticed and circumvent the justice system, which is why greater caution and effective mechanisms are needed to identify and reduce of such demands.
