The regulation of romantic relationships is a reality in the Brazilian legal system, so much so that it is the subject of analysis in Family Law, a matter aimed at protecting individuals and intimidating their families. Since it results from the complexity of human relationships, this legal branch remains surrounded by new doctrinal and jurisprudential debates. Among the most recent uproars, the legal possibility of concluding dating contracts has stood out, since it is a relationship without express provision in the Civil Code, differentiating itself from marriage and stable unions in comparison to the requirements that qualify them. In dating, there is no clear intention to form a family, but only the continuity of the loving relationship, despite being public and strict, the parties do not intend to form a family, whose contract is intended to protect the effects of the union. stable, such as sharing of assets, pension, inheritance and others. Despite not being regulated by legislation and due to the constant provocations regarding it, this contract is considered atypical and may be valid as long as the legal hypotheses of existence and validity are met, whose legal elements and effects are objects of study in this article. Carried out through the deductive method of bibliographical research, this legal study was prepared in the form of a literature review and aims to present the doctrinal and jurisprudential discussion in order to assess the legal effects resulting from a dating contract.
