PSYCHOPATHY AS A CAUSE OF CRIMINAL IMPUTABILITY

This article aimed to reflect on psychopathy as a cause of criminal imputability, seeking to show, based on literature reviews already produced, the way in which the Brazilian penal system behaves in the face of crimes committed by psychopathic individuals. A descriptive research was carried out, with a qualitative approach, where the bibliographical survey was carried out over a period of time, through readings in article publications, electronic magazines and specialized books and consulted in the FAMETRO library collection, in the period from 2017 to 2023. The theme brought a very significant basis that is necessary to better understand the great difficulty in applying criminal sanctions to criminal individuals with psychopathy. Considering the relevance of research on psychopathy as a cause of criminal liability, it is expected that researchers and professionals in the field will continue to investigate and hold debates on this issue. Only through in-depth studies and dialogue between different disciplines such as Psychology, Law and Neuroscience will it be possible to advance the understanding of psychopathy and its application in the legal sphere.
