Society must recognize the fragility of our legal system in order to combat crime, which is one of the main reasons why criminals continue to commit new crimes after evading the prison system. To this end, the alarming rates of criminal recidivism must be analyzed. So, through the analysis of these indices, it is necessary to identify the sociological, criminological and psychological bases that surround the crime and the prison environment, in order to characterize the profile of those who delinquent and why they delinquent. To that end, the methodology of documentary analysis is used, through scientific articles, monographs already published, legislation in force, magazines and doctrines, especially the doctrines of Guilherme de Souza Nucci, Cezar Roberto Bitencourt, Cesare Beccaria, Rogério Greco, who deal with criminology, psychology, sociology, as well as the theoretical aspects behind criminal law, these being the necessary means to support this scientific article.
