Adoption and homosexuality are themes that have been present throughout the evolution of society. Even so, the legal treatment given to them is still dissonant: while adoption has been elevated to a prominent place in the composition of the civil kinship bond, with a recognized social function, same-sex relationships still remain in the obscurity of the law. Due to current social demands, it is necessary to rethink the treatment given to these alternative forms of family formation, so that they too can benefit from the special protection of the State. Adoption by homosexuals must also be considered as a capable mechanism for mitigating the marginalization and crime that today haunt urban communities, expanding the possibility of family accommodation for minors abandoned on the streets, in shelters or in traditional families unable to provide full assistance.
