Every child and adolescent in Brazil is entitled to have rights. Such a statement is not an easy task in a country as exclusionary and unequal as Brazil. More than 30 years have passed since the enactment of the Statute of Children and Adolescents – ECA (1990) and our children and adolescents are still not safe from all types of violations and violence typified. Thus, based on a bibliographical review and documental analysis, the right to health of this segment is discussed, highlighting the scenario that involves children and adolescents, problematizing about the enjoyment of the right to health. As a result, the advances since the enactment of the ECA are ratified, however we draw attention to the numerous challenges and the need to reflect and highlight these issues in order to uncompromisingly defend the enjoyment of the rights of Brazilian children and adolescents.
