ANALYSIS OF THE RIGHT OF VICTIMS OF MORAL HARASSMENT AT WORK IN THE LIGHT OF THE CURRENT LEGISLATION

Society is facing a very large social and industrial development, which instigates the greedy search for success and profit at any cost, which may be one of the factors that contribute to moral harassment at work. In this context, the worker becomes vulnerable to certain embarrassing situations, his work becomes forced and without motivation, especially when he is exposed to humiliation and threats, which cause situations of fear and psychological torture. Distressed, the harassed person often suffers silently for fear of losing his/her job and does not seek legal protection, for not knowing his/her rights. Another relevant factor is the perverse ethics on the part of employers and directive abuse from higher echelons of the administration, which hurt the most important principle of the higher law, the principle of human dignity. Another very common situation experienced nowadays are the goals imposed by companies which, through inequality and subordination, cause employees to be humiliated and harassed on a daily basis, forcing them to comply with them. In this sense, this study is important for society, because it may help to clarify the issue in question, as it is a controversial and much debated issue today, because many suffer and do not know that it is moral harassment, whose practice hurts the principle of human dignity and so, mainly seek to demonstrate that there are legal rules to contain moral harassment.
