Introduction: The research highlights the importance of balancing the efficiency of the justice system with the protection of two fundamental rights in the criminal sphere and, therefore, discusses procedural speed and violations of fundamental rights and guarantees in Criminal Procedure. General Purpose: To analyze procedural defaults in Brazil, as well as the problems that procedural celerity would entail in the violation of fundamental rights and guarantees of law. Methodology: The research adopted a bibliographical review and systematic analysis of the literature as a methodological procedure. Results and General Discussion of Two Chapters: Over two chapters, we explore the methodological procedures, results and conclusions obtained. Verify that the delay in the processing of two criminal cases entails violation of fundamental rights, such as the presumption of innocence, ample defense or contradictory and fair trial. These violations undermine the quality of criminal justice and society's trust in the justice system. Conclusion: I conclude that procedural speed is crucial for the effectiveness of criminal justice, but it must be achieved without compromising the fundamental rights and guarantees involved. Measures are needed to optimize the functioning of the justice system, including investment in infrastructure, training of professionals and improvement of procedural standards.
