DIGITAL INHERITANCE: THE APPLICABILITY OF INHERITANCE LAW ON DIGITAL GOODS

Abstract

This scientific article aims to study the inheritance law of digital assets, addressing the law of succession, demonstrating its general notion, the modalities and principles, having as a central factor the approach to inheritance, analyzing the digital law, conceptualizing and informing about the digital heritage, highlighting the laws in force and the succession of virtual goods, where the evolution of the internet will be addressed, its main concepts and forecasts, through Digital Law, bills and the Civil Rights Framework for the Internet, based on this , this research will be carried out using the bibliographic research method, will be based on the consultation of books, textbooks and scientific articles, as well as scholars and extraordinary legislation. It will also use a deductive method, in which conclusions will be drawn on the materials selected for the study, such as doctrine, jurisprudence, scientific articles and summaries for the definition of the right to inheritance of the digital asset. Concluding at the end by the importance of an adequate normative treatment, which promotes greater legal security to the rights of the heirs, while also preserving the honor, intimacy and privacy of the deceased.
