Abstract

The objective of this article is to demonstrate the fragility of collecting and analyzing evidence in the field of computer forensics, considering the complexity of this method of expertise. We then sought to bring a survey of the main digital tools used in computer forensics, explain the process of data collection and analysis of evidence, in the aforementioned tools and demonstrate, in the process of analysis and collection of evidence, the necessary guidelines so that the inadmissibility of the vestige in question occurs. The research problem lies in: how is it possible to perform data analysis and how to use technology in the light of forensic criminal expertise? It starts from the hypothesis that digital evidence is relevant when it allows proving an element that is being investigated through the evidence. It is up to computer forensic experts to investigate, identify, collect data, analyze, interpret, preserve, document, and present the facts that emerged from digital evidence. Due to the fragility of digital evidence, its treatment needs to be standardized to guarantee its integrity and authenticity. The methodology used consisted of a bibliographic review, with a deductive, qualitative method, which can be classified as exploratory research, seeking to present an overview of the concepts, customs and principles ensured in laws, theories and doctrines thus selected on the subject.
