ACCESS TO JUSTICE AND PROTECTION OF THE VULNERABLE HOMELESS BY THE PUBLIC DEFENDER'S

The dignity of the human person today involves not only a negative action, but at the same time a positive one, when it is related to the understanding of man as a person, a citizen endowed with social dignity, being achieved through the guarantee and promotion of the rule of law of his people by invoking the justice system. According to research conducted and published in March 2020, through the Institute of Applied Economic Research – IPEA, the total number of homeless people was approximately 221,869 (two hundred and twenty-one thousand, eight hundred and sixty-nine), 82% of whom were men. The Federal Constitution guarantees the dignity of the human person, the good of all and guarantees the inviolability of the right to life, liberty, equality, security and property. In this same sense, the judiciary aims to guarantee the right to justice and protection of the vulnerable through the Public Defender's Office. This article seeks to demonstrate through an analysis how the Public Defender's Office can guarantee access to justice for these homeless people. It checks what the state has done to guarantee these rights. It analyzes the performance of the Public Defender's Office as vulnerable costs.
