Abstract

Nowadays it is being widely discussed whether some verdicts given by a jury formed by lay people, without any legal basis, are fair, thus giving their vote by pure conviction, this is a very important and complex issue, bringing a heated debate in society where it generates a great divergence on the subject. It also reveals the influence of the media on the verdicts of lay jurors, which can harm defendants who are judged not for a specific crime, but for their appearance and information that is obtained through the media. This article aims to analyze and critically demonstrate the verdicts and the damages caused by the lack of technical knowledge of the jurors that make up the jury commissions, some historical facts and its introduction into Brazilian law. Thus, a deductive method was used, because the analysis provided the information questions investigated and has the purpose of clarifying, developing the problem, arriving at a proposal. For this reason, the research will have a qualitative analytical approach of research directed to the basic bibliography, because it aimed at critically analyzing the problem. The methodology applied in the present work was built through the Federal Constitution, Laws, Magazines, Books and Articles.
