Abstract

This article examines the dismissal of Brazilian labor appeals when nonparties, including law firms, pay court costs or make appeal security deposits. This qualitative, doctrinal and documentary study uses purposive selection to compare legislation with eight judicial documents read in full and three supplementary records available through an official headnote or excerpts reproduced in other decisions. The documentary cutoff was October 12, 2026. The analysis identifies three approaches: requiring payment by the appellant, allowing an exception for counsel, and accepting payment when documents link it to the case. The article argues that responsibility for appeal payments does not require personally executing the banking transaction. The documents examined revealed no identified nonparty refund request that compromised the security for enforcement. The possibility of a future refund does not justify dismissing an otherwise properly prepared appeal. Under Theme 41, Brazil's Superior Labor Court recognizes nonparty payment of court costs and cash appeal security deposits, subject to legal requirements. The article criticizes the additional work imposed on companies and courts and concludes that dismissal must rest on an actual defect in the required payments, rather than solely on the payer's identity.
