Abstract

This article analyzes the consequences of common-law marriage in Brazil. Based on an evolutionary analysis of the institute, it is evaluated how Brazilian doctrine and jurisprudence have been positioning themselves about the effects of the common-law marriage, in order to answer whether the treatment given to it has been able to guarantee equality, autonomy and family protection.
