Abstract

This research analyzes the intersection between the fundamental right to a healthy work environment and the national oversight tools of public authorities. It is a bibliographical and documentary review that maps the main legal and institutional instruments for labor protection within the Brazilian legal system. The results demonstrate that, despite the existence of a robust regulatory framework, there is a gap between the formal enshrinement of this fundamental right and its material realization, aggravated by the state's operational deficiencies and the monetization of risks. It is concluded that the preservation of the worker's physical and psychosocial integrity requires an urgent transition from a compensatory legal model to a preventive paradigm, demanding a profound change in institutional and corporate postures to ensure human dignity in the daily work environment.
