Abstract

This article analyzes the impact of the congestion of social security processes on the effectiveness of the right to social security in Brazil. The research is based on the sources of Social Security Law, primarily the Federal Constitution, the laws governing social security funding and benefits, procedural legislation, the jurisprudential position of the courts, doctrinal studies, institutional reports, and statistical data published in official documents. The methodology adopted is qualitative, exploratory, and descriptive, based on bibliographic, documentary, and jurisprudential analysis. The results indicate that the choice of the topic is justified by its profound social relevance, since for vast population groups—elderly people, people with disabilities, informal workers, and low-income families—access to social security benefits is a matter of survival and dignity. It concludes that the study is essential not only to understand the structural challenges that social security faces in Brazil, but also to indicate avenues that guarantee greater efficiency, effectiveness, and justice in the realization of fundamental rights.
