Abstract

The aim of this academic article is to deal with the issue of mandatory separation of property and the removal of STF summary 377, examining the property and succession implications involving the man who contracts a new marriage, without sharing the property of the previous marriage. The research highlights the importance of protecting the assets of ex-spouses and the search for a balance in the rights and interests of the parties involved in family relationships. In addition, the study addresses the role of the Judiciary, the legislator and society in the construction of a family law adequate to contemporary demands. Regarding the methodology adopted, emphasis is placed on the use of bibliographic, doctrinal and jurisprudential mechanisms, given that this is a predominantly theoretical topic.
