Abstract

The article aims to study the impeachment process by analyzing the legal nature of the process. Provided for in the 1988 Constitution, in art. 85 items I to VII and in Law 1.079/50 of 1950, which originates the crime of responsibility. It is also intended to point out the differences between criminal infraction (common crimes) and the infraction of responsibility, also demonstrating the procedural stages as well as the consequences of the crime of responsibility: Impeachment. In addition, we will address one of the numerous cases of impeachment, the case of Dilma Rousseff that occurred during 2016, its procedure and how it occurred. Brazil was one of the first to carry out the complete impeachment process, as can be seen in the case of Collor.
