Abstract

This article aims to assess the possibility of revision of the swap contracts affected by the high of the dollar resulting from the financial crisis of 2008. For such purpose, It will be investigated the characteristics of this contract and the legal regime applicable to surviving contractual imbalance. Finally, applying the rules about “onerosidade excessiva” it will reach the conclusion of impossibility of dissolution of those contracts.
