DOMESTIC VIOLENCE AND ITS IMPACT ON THE DEVELOPMENT OF CHILDREN AND ADOLESCENTS: A LEGAL ANALYSIS OF PROTECTION POLICIES IN BRAZIL

Domestic violence is a serious social phenomenon that transcends the marital relationship, profoundly impacting the emotional, cognitive, and social development of children and adolescents living in violent environments. Brazil has a legal framework, consolidated by the Statute of the Child and Adolescent (ECA), the Maria da Penha Law and the Henry Borel Law (Law 14.344/2022), and Law No. 13.431/2017, aimed at the comprehensive protection of these individuals. However, the effectiveness of the application of these norms and the coordination between protection agencies are still questionable. Therefore, this study aims to examine the effectiveness of current public policies in mitigating the effects of domestic violence on the development of children and adolescents, as well as to analyze the articulation between the legal system, educational institutions, and social protection agencies in Brazil. Thus, the study adopts a qualitative approach, based on bibliographic and documentary research. The relevant legislation (laws, decrees), specialized doctrine in Child and Family Law, and jurisprudence will be analyzed to construct a critical analysis of the protection system. Therefore, it is expected to identify gaps in the application of protection policies, mainly the lack of articulation between the judicial, school, and social spheres, resulting in a fragmented and insufficient approach to guarantee the comprehensive protection of minors. In this sense, the improvement and integration of existing public policies becomes fundamental, proposing a more effective intersectoral approach to address domestic violence and protect child and adolescent victims within the family environment.
