THE ANTI-FEMINICIDE PACKAGE: LEGISLATIVE ADVANCES AND THE CHALLENGES OF ITS EFFECTIVE APPLICABILITY IN THE FIGHT AGAINST GENDER-BASED VIOLENCE IN BRAZIL

Brazil has one of the highest rates of feminicide in Latin America, with underreporting and recidivism standing out as hallmarks of this phenomenon. Faced with this reality, the Brazilian State has sought to respond with legislative measures, including Law No. 14,994/2024, the so-called Anti-Feminicide Package. In view of this, this paper aims to analyze1 the challenges of the applicability of the Anti-Feminicide Package in combating gender-based violence in Brazil. The specific objectives are: to understand2 the main points of the package; to examine3 the legal and social barriers to its implementation; and to discuss4 possible paths for the effective application of the measures provided for. This research adopts a qualitative approach, based on bibliographic research, based on the analysis of doctrinal works, relevant legislation, academic articles, and official documents issued by public and institutional bodies. Thus, it is concluded that the Anti-Feminicide Package will only fulfill its transformative role if it is understood as part of a more comprehensive effort of institutional and cultural reconstruction. The effectiveness of criminal law, in this context, will depend less on the harshness of penalties and more on the State's ability to act in an integrated, welcoming and democratic manner.
