Abstract

This article explores how emerging technologies, especially Artificial Intelligence, the Internet of Things, and digital platforms, are impacting fundamental rights in Brazil. The research was based on books, legislation, and recent rulings from the higher courts. On one hand, these innovations bring new opportunities to strengthen rights and improve the delivery of public and private services. On the other hand, they raise serious concerns: the massive collection of data threatens privacy; the spread of misinformation and hate speech puts freedom of expression at risk; algorithmic biases may affect equality; and digital exclusion may limit access to justice. Given this scenario, it is crucial that legal responses keep pace with technological developments in a balanced and responsible way. The conclusion highlights the urgent need to align technological innovation with the core values of the Constitution, ensuring that human dignity remains at the center of digital transformation.
