ABORTION LAW IN FRANCE AND ITS INFLUENCES ON OUR LEGAL SYSTEM

Abstract

This paper has as its main theme the right to abortion in France and its influences on our legal system. Its objective is to investigate the social, legal and public health implications arising from the possible decriminalization of abortion in Brazilian society, using France's experience in applying the procedure and its integration into the legal system as a reference, and to propose effective strategies to guarantee women's access and right to voluntary termination of pregnancy in the Brazilian context. In this sense, abortion is still a topic under construction in our legal system, but its practice already exists in our cultural context. Therefore, taking into account that it is already a reality in our country, we must discuss the solution for regularizing this practice. The criminalization of the practice of abortion, with regard to the democratic rule of law, requires a moral justification that is in accordance with the principle of political pluralism, art. 1, item V of the Federal Constitution, and with the principle of promoting the good of all, prohibiting any type of discrimination, art. 3, item IV of the Federal Constitution. The type of research to be carried out will be a literature review, where books, dissertations and scientific articles will be researched. We hope that, at the end of this research, the results will be able to provide support for new discussions on the topic and, later, as these questions mature, can generate new proposals for a bill regarding the legalization of abortion in Brazil.
