Sexual abuse against minors is one of the most important forms of sexual violence against children and adolescents, meaning all conduct carried out by someone of an older age, who commits various sexual acts with or in the presence of a child or adolescent with the purpose of satisfying their lust, consequently violating the sexual rights of the other individual. In turn, intra-family child abuse is one in which the perpetrator is someone close to the victim, who has a biological or emotional family bond with them and fails to comply with the moral and constitutional duty to care and protect. This study aimed to discuss the practice of intra-family sexual abuse, through the adoption of the bibliographical research method based on doctrines and jurisprudence, aimed at exploring the proposed topic, exposing positions recently published in Brazil and in accordance with the laws in force. As a conclusion of the research, the definition of intra-family abuse is presented, with emphasis on the way it is characterized and, mainly, the liability as one of the crimes committed against sexual dignity provided for in the Penal Code (Decree-Law No. 2.848 /1940) and also in the Child and Adolescent Statute (Law No. 8.069/1990).
