The book "Multiparentality and Its Developments in Brazilian Inheritance Law" explores a contemporary legal phenomenon that is redefining family structures and inheritance rights in Brazil. Multiparenting, which involves the recognition of multiple parental relationships – both biological and socio-affective – is emerging as a response to the complexity of human relationships and the new family formats that are being consolidated in society.
The main objective of this work is to analyze the implications that the recognition of multiparenthood brings to Brazilian inheritance law. Given the coexistence between blood and socio-affective affiliations, the book seeks to answer crucial questions about how these relationships influence the distribution of inheritances and the definition of necessary heirs in the context of the national legal system. Based on this analysis, the work offers a comprehensive view of how succession law must adapt to accommodate this multifaceted reality.
The development of this study is based on rigorous qualitative research, using bibliographic and exploratory methods. By exploring doctrines, current legislation and relevant jurisprudence, the book offers a detailed understanding of the rules that govern filiation in Brazilian family law. Furthermore, it presents the theoretical foundations that support the institution of multiparenthood and investigates how these foundations are applied in the succession context.
The work highlights the importance of substantial equality guaranteed by the Federal Constitution, which ensures equal rights among all forms of affiliation. In this context, multiparenting is seen not only as an advance in the protection of emotional bonds, but also as a principle of justice and equity in the treatment of heirs. The members of a multiparent family entity are, therefore, recognized with full and equal rights with regard to succession, reaffirming the constitutional commitment to the equality and dignity of family relationships.
With a clear and detailed approach, "Multiparentality and Its Developments in Brazilian Inheritance Law" is essential reading for jurists, academics and all those interested in understanding the transformations and challenges that permeate family law and inheritance law in Brazil. This book makes a valuable contribution to understanding how the law can and should evolve to reflect the diversities of modern family relationships.
