Abstract

The importance of cryptocurrencies has been increasing since the launch of Bitcoin in 2008. Therefore, governments are committed to optimal regularization to ensure user safety. Currently, the Brazilian legal system lacks clear legislation and a solid doctrinal definition on the subject, which makes life difficult for users. As a result, the purpose of this study is to examine how Bitcoin and other cryptocurrencies are related to personal income tax. In the academic and legal sphere, there is an intense debate about the taxation of gains from cryptocurrencies. A review of national and international literature was carried out to improve understanding of the legal implications of digital taxation. Thus, the current work aims to take a legal approach to a recent event. It is important to highlight that the objective of this research is not to resolve all legal unknowns about bitcoin. Instead, the objective of the research is to analyze and study how its application in Brazilian law could be, contributing to a relevant subject that is still little studied by the legal community.
