PSYCHOPATHS AND THE CRIMINAL SANCTIONS APPLIED

This article aims to analyze the framing of the psychopathic criminal within the Brazilian penal system. We begin with the concept and analysis of the characteristics of individuals affected by psychopathy, enter into culpability, and then proceed with the criminal liability of the author who presents this personality disorder, thus aiming to define the place of these individuals in the current penal system. We also approached about the imputability and the penalties that could be applied to psychopaths. Finally, we evaluated the form of execution of the penalty, with regard to the possible penal benefits to be conceived. We conclude that the current system treats these individuals in the same way as common criminals. Thus, there is no doubt that it is necessary for the State to turn to this topic, of relevant interest, which to this day remains on the margins of diffuse interpretations. Finally, the methodological approach was applied to content exploration methods, seeking information in books and scientific articles, in order to better clarify the subject.
