UBERIZATION: A CRITICAL ANALYSIS OF ESSENTIAL ELEMENTS IN THE CONFIGURATION OF THE EMPLOYMENT RELATIONSHIP

The present work aimed to study the phenomenon of "uberization" and its impacts on the employment relationship, in order to demonstrate whether or not there is an employment relationship in this situation and if such phenomenon evidences the precariousness of workers' rights. It can be seen that this phenomenon is broadly linked to a new capitalist model, known as "collaborative capitalism", in which the main characteristic is the sharing of human resources. However, this economic bias urges negative effects on the worker from the perspective of Brazilian Labor Law, given the alteration of the employment relationship that is apparently nonexistent in this relationship. Even if all elements of the employment relationship are evidenced, there is much debate in the legal network on the topic. Therefore, it is noted that uberization is an event derived from economic crises and represents for the worker a mechanism that, so far, ignores some of their rights. It is concluded that in jurisprudence, there are mostly decisions that deny the employment relationship. The methodology adopted was that of inductive bibliographic-documentary review.
