LABOR REFORM: THE IMPACT OF THE COLLECTIVE DISMISSAL OF WORKERS IN PANDEMIC TIMES LINKED TO THE INCREASE IN UNEMPLOYMENT AND INFORMAL WORKERS

This article is about labor reform: the impact of the collective layoff of workers in times of a pandemic linked to the increase in unemployment and informal workers. The general objective of the work is to analyze the impact of the collective dismissal of workers in times of a pandemic and its relationship with the increase in unemployment and informal workers. Bibliographic studies were carried out to obtain theoretical foundations on the subject and, in the sequence, a survey was carried out with a quantitative approach, based on the technique of data collection, through social networks (WhatsApp and Instagram), through an online questionnaire, being that 85.23% (75 people) of the participants responded that the collective dismissal promoted an increase in unemployment and informal workers, in the period of the COVID-19 pandemic. It should be noted that the contracting party has the burden of demonstrating that the application of provisional measures No. 927/2020 and No. 936/2020, which aims to maintain the employment contract. It is concluded that if the employer does not prove the appropriateness, he may be subject to the null penalty of collective dismissal, which can only be carried out as a last resort.
